These Parking Facility Terms and Conditions (the “Terms”) govern use of the private parking facility known as the Washington St. Lot, located at 235 Washington St., Green Bay, WI 54301 (the “Facility”). The Facility is owned by MOWGS, LLC, a Wisconsin limited liability company (the “Facility Owner”). The Facility Owner and its employees, agents, and contractors acting in connection with the Facility are referred to collectively as the “Facility Parties.”
Important NoticeTHE FACILITY IS PRIVATE PROPERTY. LICENSE PLATE RECOGNITION TECHNOLOGY IS IN USE. PARKING IS SUBJECT TO THE POSTED RATES, RESTRICTIONS, AND THESE TERMS.
By parking a vehicle in the Facility, or remaining in the Facility after a reasonable opportunity to review these Terms and the posted rates and restrictions, the person operating the vehicle (the “User”) accepts these Terms for that parking session. A User who does not agree to these Terms must leave the Facility within the posted ten-minute exit grace period.
1. Permission to Park; Posted Signs
The User receives only a limited, revocable license to park in an authorized parking space during the applicable parking session. Parking availability is not guaranteed, and permission to park during one parking session does not create any right to park on a future occasion. The User must comply with these Terms, all conspicuously posted signs and restrictions, and any lawful instructions provided by the Facility Owner or its personnel. Facility-specific signs, the payment confirmation for the applicable parking session, and any applicable pass or validation terms are incorporated into these Terms. A more specific rate, restriction, or requirement applicable to a particular space, area, vehicle, or parking session controls over these general Terms with respect to the matter specifically addressed.
2. Rates, Payment, Validations, and Passes
The User must pay the parking rate and any mandatory fee conspicuously posted for the applicable parking session. Posted rates may include hourly, daily, flat, maximum, or special-event rates. Special-event rates apply when posted for the applicable date or period. Payment may be made by scanning the QR code displayed on Facility signage or by visiting ParkGB.com. Before completing payment, the User is responsible for confirming that the correct Facility, vehicle license plate, parking period, and payment information have been entered. A User who discovers an error should promptly contact the Facility using the contact information below. All applicable charges must be paid, an authorized validation must be completed, or the vehicle must be covered by a valid parking pass before the vehicle exits the Facility. Validations and parking passes: (a) Apply only according to their stated terms, limitations, eligibility requirements, and expiration dates; (b) Reduce parking charges only to the extent expressly stated; (c) Do not authorize parking in violation of these Terms or posted restrictions; (d) May not be transferred or shared unless expressly permitted; and (e) Do not guarantee the availability of a particular parking space. The User remains responsible for any charge not covered by a valid validation or pass. After payment or validation, the vehicle must exit within the posted 10-minute exit grace period. The exit grace period is provided only to allow the vehicle to leave after payment or validation. It does not extend the paid parking period. Additional parking charges may apply under the posted rates if the vehicle does not exit within that period. If a payment system, validation system, or exit gate does not operate properly, the User must contact the posted assistance number. The User may not bypass or damage access-control equipment or follow another vehicle through a controlled exit. The User is responsible for charges arising from the User's parking session. A registered vehicle owner who is not the User is responsible only to the extent provided by applicable law or a separate agreement applicable to the vehicle, parking account, pass, or permit.
3. Parking and Facility Rules
The User must operate and park the vehicle safely and comply with all posted traffic controls, time limits, hours of operation, payment requirements, and parking restrictions. A vehicle may not: (a) Be parked without payment, a valid validation, or a valid pass when payment or authorization is required; (b) Remain beyond an applicable parking period or time limit; (c) Be parked in a reserved, permit-only, restricted, or accessible parking space without the required authorization; (d) Be parked outside a designated parking space or occupy more than one space unless expressly authorized; (e) Block another vehicle, traffic lane, driveway, entrance, exit, fire lane, loading area, access aisle, pedestrian route, or other restricted area; (f) Remain in the Facility outside posted hours of operation; (g) Be abandoned, stored, or left in an inoperable condition without the Facility Owner's prior written authorization; (h) Be repaired, washed, refueled, or serviced in the Facility, except for reasonable emergency measures; (i) Be operated in an unsafe manner or used to bypass or tailgate through access-control equipment; or (j) Be used in connection with unlawful, hazardous, or disruptive activity. The User may not damage or interfere with gates, cameras, signs, payment equipment, lighting, or other Facility property. Payment of a parking charge does not authorize violation of any posted restriction.
4. Enforcement and Towing
Failure to pay an applicable parking charge or comply with these Terms or a posted restriction may result in one or more of the following: (a) Collection of unpaid parking charges and any enforcement fee expressly disclosed for the applicable parking session; (b) Denial, suspension, or revocation of parking privileges; and (c) Towing or removal of the vehicle at the vehicle owner's expense, as permitted by applicable law. A vehicle parked in a prohibited location, creating an obstruction or safety risk, or otherwise qualifying for immediate removal under applicable law may be towed without prior notice to the User beyond any notice required by law. Towing will be conducted in accordance with applicable law and required Facility signage.
5. License Plate Recognition and Privacy
The Facility uses license plate recognition technology (“LPR”). LPR equipment may collect: (a) Vehicle license plate numbers; (b) Images of vehicles and their license plates; and (c) Dates and times of entry into and exit from the Facility. LPR and related parking information may be used to: (i) Determine parking duration and applicable charges; (ii) Process and verify parking payments; (iii) Administer parking passes, permits, and validations; (iv) Identify unpaid or unauthorized parking; (v) Enforce parking rules and restrictions; (vi) Prevent fraud, misuse, or abuse; (vii) Support Facility operations, security, customer service, and dispute resolution; and (viii) Comply with applicable legal requirements. Information may be processed by parking-management, payment-processing, security, enforcement, customer-service, and technology service providers acting on behalf of a Facility Party. Information may also be disclosed to law enforcement or other governmental authorities when required or permitted by applicable law or valid legal process. The use of LPR, cameras, gates, lighting, or other equipment does not guarantee the security of any vehicle or personal property.
6. No Bailment; Vehicle and Personal Property
Parking grants only a limited license to occupy an authorized parking space. Neither entry into the Facility, payment of a parking charge, nor use of a parking space creates a bailment or custodial relationship. No Facility Party accepts possession, custody, or control of any vehicle or personal property located in or on a vehicle. The User remains responsible for: (a) Locking and securing the vehicle; (b) Closing windows and removing keys; (c) Safeguarding personal property; and (d) Taking reasonable precautions against theft, vandalism, and damage. To the fullest extent permitted by applicable law, the Facility Parties are not responsible for loss of or damage to a vehicle or personal property resulting from theft, vandalism, weather, fire, flooding, collision caused by another person, acts or omissions of third parties, or other risks ordinarily associated with use of an unattended parking facility, except to the extent directly caused by a Facility Party's negligence or willful misconduct. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
7. User Responsibility for Injury and Damage
The User is responsible for personal injury, property damage, and damage to the Facility to the extent caused by: (a) The User's negligent, reckless, or intentional act or omission; (b) The operation, condition, or movement of the User's vehicle; (c) The User's violation of applicable law; or (d) The User's material violation of these Terms or a posted parking restriction. The User must reimburse the Facility Owner for the reasonable cost of repairing damage to the Facility caused by the User or the User's vehicle.
8. Changes to Terms
The version of these Terms made available for the Facility at the beginning of a parking session applies to that session. The Terms may be updated from time to time, but an update will apply only to parking sessions beginning after the updated Terms take effect. Material changes to rates, mandatory fees, or Facility-specific parking restrictions will also be reflected on applicable Facility signage or in the applicable payment process. 9. General Terms
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the extent permitted by law, and the remaining provisions will remain effective. Each Facility Party is an intended beneficiary of, and may enforce, any provision of these Terms that expressly protects that Facility Party.
